These terms and conditions form the basis on which you can visit us and our website.  Please read them carefully as they contain important information.

General terms and conditions

The site is rented and operated by MJB TOURER SERVICES of A38 Redhill, Wrington, Bristol, BS40 5TG.  If you have any queries about these terms and conditions or if you have any comments or complaints on or about our website, you can contact us at info@mjbtourerservices.co.uk or 01934 862864.

1.  The Contract between us

If booking in person, by telephone or email, we will create your booking with description of the services/repairs required.  MJB TOURER SERVICES will ask, on the day of attendance at our premises with your leisure vehicle, for your confirmation as to the work to be undertaken.  Only at this point is a legally binding contract created between us.  At MJB TOURER SERVICES discretion we may ask for part or full payment before proceeding, or a staged payment.  If we have not asked for payment in advance, we request full payment on completion of the service.

1.1 Leisure Services

MJB TOURER SERVICES operates in the leisure sector, supplying services for consumers in their leisure time and leisure vehicle use.  MJB TOURER SERVICES does not supply services fit for commercial vehicles, or vehicles being used for commercial activites, or long term habitation.

If you have not disclosed information at the point of order that would enable MJB TOURER SERVICES to assess the way in which the vehicle is used, all service and repair warranties applicable are void and the services provided are used at your own risk.

2.  Acknowledgement of your booking

Your booking will be acknowledged either on the telephone when made or by email if that is how you have contacted MJB TOURER SERVICES.  We will take your name, telephone number, registration number and make and model of your leisure vehicle as we make the booking.  This information is placed into a hand written diary and stored in our computer accounting system for invoicing purposes only.  If you have an email address we will happily take this and contact you this way if you would prefer.  We do not store private addresses or banking details at all.  For the avoidance of doubt, this correspondence does not constitute a contract between us.

3.  Ownership of rights

All rights, including copyright, in this website are owned by or licensed to MJB TOURER SERVICES.  Any use of this website or its contents, including copying or storing it or them in whole or part, other than for your own personal, non-commercial use, is prohibited without our permission.  You may not modify, distribute or repost anything on this website for any purpose.

4.  Accuracy of content

We have taken care in the preparation of the content of this website, in particular, to ensure that prices quoted are correct at the time of publishing and that all services have been described accurately. MJB TOURER SERVICES reserve the right to change prices at any time.

5.  Damage to your computer

We try to ensure that this website is free from viruses or defects.  However, MJB TOURER SERVICES cannot guarantee that your use of this website or any websites accessible through it will not cause damage to your computer.  It is your responsibility to ensure that the right equipment is available to use the website.  Except in the case of negligence on our part, we will not be liable to any person for any loss or damage which may arise to computer equipment as a result of using this website.

6.  Availability

The services will be provided within an agreed timescale, although MJB TOURER SERVICES reserve the right to alter this timescale due to circumstances beyond our control.  Time is not the essence of the contract.

7.  Manufacturer warranty

It is the responsibility of the owner of the vehicle to inform MJB TOURER SERVICES of any manufacturer warranty that is still applicable.

8.  Price

The prices payable for specific services that you request are as set out on our website.  Other services provided are charged at our hourly rate in force at the time of the contract.  All prices shown are inclusive of VAT at the current rates and are correct at the time of entering information.

9.  Payment terms

For all services provided, full payment is required on completion of works and before your leisure vehicle can be taken away from the premises of MJB TOURER SERVICES.  We will accept payment by debit/credit card, cash or bank transfer.  The amount payable will obviously be reduced by any upfront payment or stage payment already made.  All vehicles should be collected within seven days of invoicing and contact from MJB TOURER SERVICES to let you know the work is completed.  If the vehicle is left on the premises of MJB TOURER SERVICES any longer then we reserve the right to charge £5 per day storage fee.

10. Cancellation

You have the right to cancel your booking with MJB TOURER SERVICES as long as work has not commenced on your leisure vehicle.  If you have booked for more than one job, you cannot cancel any part of the booking that has already been started but you can cancel any part that has not been started.  MJB TOURER SERVICES will accept cancellation by any clear means e.g. telephone call, email, in person.

11.  If there is a problem with the services

11.1 If you have any questions or complaints about the services please contact MJB TOURER SERVICES in the first instance.  You can do so at info@mjbtourerservices.co.uk or 01934 862864.

11.2 We are under a legal duty to supply services that are in conformity with the contract between you the consumer and MJB TOURER SERVICES and in accordance with the Consumer Rights Act 2015.

12.  Liability

12.1 All vehicles are left on the premises of MJB TOURER SERVICES at the owners own risk.

12.2  Winterisation (the removing of all water from the internal water system) is the sole responsibility of the owner of the leisure vehicle.  MJB TOURER SERVICES accept no responsibility for any frost damage to water systems and appliances, including taps, whilst a leisure vehicle of any description is on their premises.

12.3  It is the responsibility of the owner of the leisure vehicle of any description NOT MJB TOURER SERVICES to make sure the vehicle is winterised correctly  (as in section 12.2 above and also to include consideration to the internal fixtures and fittings and ventilation of the leisure vehicle) before being left on the premises of MJB TOURER SERVICES during the winter months.  MJB TOURER SERVICES accept no responsibility for winterising a customer vehicle or damage caused to a customer vehicle by non compliance with this subsection.

12.4 We are only responsible for losses that are a natural, foreseeable consequence of our breach of these terms and conditions.  We do not accept liability if we are prevented or delayed from complying with our obligations set out in these terms and conditions by anything you (or anyone acting with your express or implied authority) does or fails to do, or is due to events which are beyond our reasonable control.

12.5 Furthermore, we do not accept liability for any losses related to any business of yours including but not limited to: lost data, lost profits, lost revenues or business interruption.

12.6 In the extreme circumstance of a catastrophic event that necessitates the writing off of your leisure vehicle, we limit our liability to no more than an economic market value of your leisure vehicle at the time.

12.7 Notwithstanding the foregoing, nothing in these terms and conditions is intended to limit any rights you might have as a consumer under applicable local law or other statutory rights that may not be excluded nor in any way to exclude or limit our liability to you for any death or personal injury resulting from our neglience.

13.  Changes to legal notices

We reserve the right to change these terms and conditions from time to time and you should look through them as often as possible.

14. Law, jurisdiction and language

This website, any content contained there in and any contract brought into being as a result of usage of this website or any other form of contact are governed by and construed in accordance with English law.  Parties to any such contract agree to submit to the exclusive jurisdiction of the courts of England and Wales.  All contracts are concluded in English.

15.  Invalidity

If any part of these terms and conditions is unenforceable (including any provision in which we exclude our liability to you) the enforceability of any other part of these conditions will not be affected.

16.  Privacy

Our privacy policy dictates that we do not store anything other than your name, telephone number, registration number of your leisure vehicle and email address if you share it with us.  We do not share this information with anyone unless you request us to do so.  You acknowledge and agree to be bound by the terms of our privacy policy.

17.  Third party rights

Nothing in this Agreement is intended to, nor shall it confer any rights on a third party.

18.  Specific damp repair warranty

All damp repairs undertaken by MJB TOURER SERVICES come with an automatic 12 month warranty subject to a post work inspection within 3 months of completion of the repair.  The post work inspection is the responsibility of the consumer to arrange with our selves and we do not offer a contact service for this work.

19.  Other important terms

Alternative dispute resolution is a process where an independent body considers the facts of a dispute and seeks to resolve it, without you having to go to court.  If you are not happy with how we have handled any complaint, you may submit the dispute for online resolution to the European Commission Online Dispute Resolution platform.
